(Clearwisdom.net) On March 1, 2010, the Falun Gong Human Rights Working Group submitted the case of the disappearance of Mr. Feng Jiang to the UN. Mr. Jiang is the husband of Xuan Mei, an erhu soloist in Shen Yun Performing Arts.
Ms. Mei Xuan and her husband Mr. Jiang Feng
On the afternoon of February 18, 2010, Mr. Jiang was scheduled to fly to the United States to visit his wife. Relatives who accompanied him to the Shanghai Pudong Airport said he passed the security checkpoint on time. His name was also on the boarding list for Continental Airline flight C086. However, he never arrived in Newark, NJ. Airport inquiries indicated that he never boarded the plane. Mr. Jiang apparently disappeared during the very short time between passing through the security checkpoint and the final boarding.
Representatives of the Falun Gong Human Rights Working Group are attending the UN Human Rights meeting in Geneva.
Ms. Mei believes that special agents and police from the 610 Office and the National Security Bureau abducted her husband. "They must release my husband immediately," said Ms. Mei.
In a media interview, Ms. Mei said, "In order to disrupt Shen Yun performances, the Chinese Communist regime not only abducted my husband on the 18th, but also abducted my mother a month before the Shen Yun world tour started for this season. The police have harassed and threatened all of my family members, which has caused my father to become seriously ill."
According to reports, when asked about Mr. Jiang's arrest, an official from the
Department of Consular Affairs at China's Ministry of Foreign Affairs said the situation must have been approved by the central government. The Shanghai Security Bureau and the 610 Office refused to reveal more details.
On February 22, an official stated that Jiang's arrest was conducted by the Shanghai 610 Office. After talking to a supervisor, the official said the situation must have been approved by the central government. The reporter was advised to contact the Central Committee of the Chinese Communist Party (CCP).
UN International Convention on Enforced or Involuntary Disappearances
As a member state of the United Nations, China is aware of related international laws. On December 20, 2006, the United Nations General Assembly adopted the "International Convention for the Protection of All Persons from Enforced Disappearance" which
states:
"...aware of the extreme seriousness of enforced disappearance, which constitutes a crime and, in certain circumstances defined in international law, a crime against humanity,"
"...the widespread or systematic practice of enforced disappearance constitutes a crime against humanity as defined in applicable international law and shall attract the consequences provided for under such applicable international law."
The convention states: "...to hold criminally responsible at least:
(a) Any person who commits, orders, solicits or induces the commission of, attempts to commit, is an accomplice to or participates in an enforced disappearance
(b) A superior who:
(i) Knew, or consciously disregarded information which clearly
indicated, that subordinates under his or her effective authority
and control were committing or about to commit a crime of enforced
disappearance
(ii) Exercised effective responsibility for and control over
activities which were concerned with the crime of enforced
disappearance, and
(iii) Failed to take all necessary and reasonable measures within
his or her power to prevent or repress the commission of an
enforced disappearance or to submit the matter to the competent
authorities for investigation and prosecution."
The CCP knows this, but in practice, the CCP officials commit the unforgivable crime.
Falun Gong Human Rights Working Group Reports Case to United Nations
The Falun Gong Human Rights Working Group submitted the case of Mr. Jiang's disappearance to the UN Working Group on Enforced or Involuntary Disappearances, and charged the "610 Office," the National Security Bureau, the Shanghai Police Station, and the Shanghai Pudong Airport with the responsibility in the case. The Falun Gong Human Rights Working Group meanwhile also submitted an urgent appeal to the UN Special Rapporteur on Freedom of Religion and Belief.
For the past two weeks since Mr. Jiang's disappearance, the Chinese government has not provided any documents or explanation to his family members. This is typical in a case of Enforced or Involuntary Disappearances. This type of crime causes more pain to the victims and their family members than many other of China's human rights abuses. In China, the CCP government often uses this method, and uses the entire country's political machine to persecute peaceful cultivators and their family members.
The Falun Gong Human Rights Working Group has submitted hundreds of disappearance cases for Falun Gong practitioners to the UN. Some of the practitioners returned home after a period of time, but most seemingly disappeared forever. For example, Mr. Hua Wanqing, a practitioner in the U.S., has not spoken to his brother, Mr. Huang Xiong, since April 19, 2003. Mr. Huang Xiong also disappeared in Shanghai.
The UN has accepted several thousand cases of persecution of Falun Gong practitioners in China, and the CCP persecution has become a known fact. The CCP's recent persecution of Shen Yun artist's family members is an example of how the Chinese government's suppression is extending around the world. As more facts are exposed, we believe the international community will take action to ensure that the responsible CCP officials are brought to justice.
