Ms. Xing Dan Illegally Tried Despite Being Critically Ill

(Minghui.org) The Tiedong District Court in Anshan City, Liaoning Province, tried Falun Gong practitioner Ms. Xing Dan for a second time on January 23, 2015. Her first trial, held on November 14 last year, was canceled after Ms. Xing suffered a heart attack.

Ms. Xing was extremely feeble and had to be carried into the courtroom. Five minutes after the trial began, she started to have symptoms of a heart attack. She had difficulty breathing and began twitching. She was finally carried out of the courtroom. Ten minutes later, she was brought back. During the trial, two officers had to support her, otherwise she would have collapsed.

Ms. Xing, a high school English teacher, was illegally arrested at home on July 21, 2014, because she practices Falun Gong. She has been held at the Anshan Detention Center ever since. The authorities ignored the fact that she was critically ill, instead, they told her, “You'll be released if you renounce Falun Gong. Otherwise, you'll be kept here.”

Ms. Xing's family is extremely worried. Her mother said, “Xing Dan has been weak and ill since she was a child. She became free of illness shortly after she started practicing Falun Gong. However, she is now detained just because she practices it. She is now critically ill but the authorities will not allow her to be treated. Who is going to be held responsible should anything happen to her?”

Attorney Not Allowed to Defend Client

During the cross-examination, Ms. Xing's attorney asked the prosecutor, Gao Xin, to present the evidence, but judge Huang Jin ignored his request.

In order to have a fair trial, Ms. Xing's attorney asked the judge to excuse himself from the trial because he was making prejudicial statements against Ms. Xing. Ten minutes after the judge left the courtroom, he came back claiming that the court president approved his continuing to preside over the trial.

Ms. Xing's attorney began presenting his defense statement by stating that Falun Gong is legitimate in China. Judge Huang stopped him by declaring a dismissal, thereby depriving her attorney of his right to defend her and her right as a defendant to make a final statement.

Before the trial, Ms. Xing's attorney had dealt with judge Huang several times. Huang said, “The bosses' words are the law.” Gao Tai, the presiding judge, claimed, “The Anshan 610 Office was set up by three people. I was one of them.”
