Heilongjiang Doctor Appeals Prison Sentence Issued Under Dubious Circumstances

(Minghui.org) The public prosecutor was reading aloud his “witness testimony” from the indictment document when the defense attorney interjected, “Which page are you reading?”

“Page 22.”

The defense attorney raised his case folder and pointed out that his copy of the documentation contained no such witness testimony. His file was a copy of the case file issued by the Procuratorate, which originally contained no such witness. It became apparent that the file had been tampered with and the testimony added without validation and proper procedure.

Ms. Miao Wenchao's (苗文超) was tried in the Daoli District Court in Heilongjiang Province on December 5, 2014. Despite the irregularities, she was sentenced to three and a half years six days later.

Ms. Miao's only “crime” was her practice of Falun Gong, a self-cultivation system being persecuted by the Chinese Communist Party.

Ms. Miao's Arrest and Own Defense

Ms. Miao, 42, is a doctor at the Third Hospital with Harbin Medical University. She was taken away from work on April 25, 2014, and her arrest was approved in mid-May.

During her trial, Ms. Miao stated, “I may be sentenced or lose my job simply for practicing Falun Gong, but I don't regret my choice. There is nothing wrong with my striving to be a good person following the principles of Truthfulness-Compassion-Forbearance. The Chinese Communist Party is wrong in persecuting Falun Gong, and I will continue to exercise my legal right to raise awareness of the persecution.”

Ms. Miao's Appeal

Ms. Miao appealed to the Harbin Intermediate Court on December 25, 2014. She has requested a public hearing for her case.

She reiterated her innocence in her petition: “Article 35 of the Constitution guarantees citizens' right to freedom of belief, and it is my right to practice Falun Gong. The persecution of Falun Gong lacks legal basis from day 1. I urge the Harbin Intermediate Court to overturn the original verdict.”
