Shaanxi Man Arrested After Eight Years on the Run, Case in Limbo as Trial Court Judge Looks to Appeals Court for Guidance

(Minghui.org) After eight years of moving from place to place to avoid being persecuted for his faith in Falun Gong, Mr. Kuang Dongliang was arrested on September 26, 2017 when he returned to his hometown of Hanyin County, Shaanxi Province to visit his parents.

Falun Gong, also known as Falun Dafa, is a spiritual discipline that has been persecuted by the Chinese communist regime since 1999.

During the past two years he was held at Hanyin County Detention Center, Mr. Kuang appeared in Hanyin County Court twice, first on September 27, 2018 and then on May 6, 2019. He acted as his own lawyer and defended his innocence.

His parents, in their 70s, and his wife attended his first hearing, but were barred from attending the second one.

Prosecutor Luo charged him with “undermining law enforcement with a cult organization,” a standard pretext used by the Chinese courts to frame and imprison Falun Gong practitioners.

Mr. Kuang argued that no law in China has criminalized Falun Gong or defined it as a cult. The prosecutor didn't respond when Mr. Kuang challenged him to provide which law he had allegedly undermined.

The judge told Mr. Kuang on June 10, 2019 that they had transferred his case to the local appeals court because he was “unable to make decision.”

Mr. Kuang's family suspects that the judge at the trial court didn’t want to wrongfully sentence him, but due to pressure from the higher-ups, he couldn’t acquit him either.
