As the Haidian People's Procurator Office had rejected Ms. Zhao Xin's case, Ms. Zhao's family, accompanied by her lawyer went there to resubmit the accusation letter on the afternoon of July 7. They waited at the entrance of the Accusation Department, for long time, until Zhang Jifeng, the associate director, met them. Standing in the lobby, Mr. Zhang asked why they were there. They answered that they had come to resubmit the accusation letter. After taking a look at the application, Zhang Jifeng declared the family could not resubmit the accusation letter without a formal written notice from the Haidian Procurator Office confirming their refusal to register the case. It seemed ridiculous to the family, as it was this associate director who verbally informed Ms. Zhao's family that he would not handle the case and refused to provide a written explanation for not accepting the case. This occurred when they visited the Accusation Department the first time on June 30. According to the relevant law in China, if the Procurator Office decides not to accept a case, they must provide a written explanation of the reason for refusing the case within 7 days after receiving the accusation letter. Mr. Fan, the director of the Accusation Department of the 1st Branch of the Beijing Procuratorate, told the family, when they visited his office on July 3, that they could resubmit the accusation letter, even though they were only verbally notified that the case was refused. Therefore, they wondered whether Mr. Zhang didn't know the relevant regulation, or he intentionally and purposefully tried to make trouble for the victim's family, who came from outside of Beijing, or there were other reasons. Did his behavior measure up to the standards of a procurator? Let's examine his behavior: First, he did not permit the victim's family to enter the office; second, he refused to accept the accusation letter without a proper explanation. He then scolded the family, instead of giving a clear polite explanation while they asked for the reason for the refusal, which did not mitigate the rude response. He did not treat Ms Zhao's family fairly as a procurator should, which damages the reputation of all procurators. Even worse, in a menacing manner, he said to the lawyer, "Take the accusation letter away". The lawyer refused. Everyone present was shocked and taken aback by his rude and irresponsible behavior.
After that, Ms Zhao's family returned to the 1st Branch of the Beijing People's Procuratorate. Mr. Wang, a procurator in the Accusation Department received them in a good manner. He agreed to report the case to his supervisor and promised to give them a reply soon. He pointed out, clearly, that the Haidian People's Procurator Office had no right to refuse an accusation letter.
Rushing around for half a day, they still had no result. When can Ms. Zhao's family expect the injustice of Zhao Xin's case to be reversed?
