To the Superior People's Court of Qinghai Province
My name is He Wanji. I am a male of the Han ethnicity, born on June 13, 1951, and a college graduate. I lived at Room 102, Unit 7, Building 28 at the Binhe sub district, Chengdong District, Xining City, Qinghai Province. I am now detained at the No. 1 Detention Center in Xining City.
As the plaintiff, I, He Wanji, would like to plead innocent to the charges and sentence handed down by the Intermediate People's Court of Xining City in its "Criminal Judgment" (2003). In this judgment, plaintiff He Wanji was sentenced to 11 years for "Felony using an organized cult to interfere with law enforcement," and another 9 years for the "Felony of destroying TV broadcasting equipment," for a total term of 17 years. The plaintiff hereby files this appeal with the Superior People's Court of Qinghai Province.
The reason for the appeal:
1. Falun Gong is a cultivation practice, not a cult or religion.
Falun Gong is an advanced cultivation practice based on the Buddha School. Falun Gong teaches people to practice compassion. Falun Gong cultivates both mind and body and is based on the principle of Truth, Compassion, Forbearance. Falun Gong has been highly regarded by the country's General Administration of Athletics, and was warmly welcomed during the 1992 and 1993 Beijing Qigong and Health Expo. Falun Gong received the one and only top "Award for Advancing Boundary Science" at the 1993 Beijing Qigong and Health Expo. The publisher of the book Zhuan Falun that was authored by Mr. Li Hongzhi was the China Central Broadcasting Publishing House. Zhuan Falun was one of the most popular books enjoyed by millions of people both in China and around the world. In his book, Zhuan Falun, Mr. Li Hongzhi requires that a practitioner must strive to be a good person first, a person who is unselfish, and who puts other people's interests ahead of self-interest.
I indeed accomplished this on my job to safeguard the rail transportation operation and safety. I was very dedicated to my work. I was very meticulous; I worked hard and did not become upset by criticism. I received high praise from my colleagues and management. I was publicly recognized many times as an advanced worker and a proactive member of the union. I was awarded the titles of "Outstanding Member of the Communist Party" and the "Advanced Worker of Xining Railroad Bureau."
I do not believe that Falun Gong is a cult, or an organization. I practice Falun Gong because I want to be a good person, a better person. I participated in group exercises with other citizens at large. Therefore, the prosecutor's charge, and the sentence of "Felony of using an organized cult to interfere with law enforcement" issued by the Xining City Intermediate People's Court is false and invalid.
2. I have been persecuted.
I went to Beijing to appeal against the persecution of Falun Gong in 2000 because I was forced to do so after my employment was terminated without reason by the management and I had no other means to appeal. A citizen's appeal is a constitutional right guaranteed by the "Constitution of the People's Republic of China" to Chinese citizens. It is also a citizen's obligation. This right and obligation cannot be stripped away by anyone or any organization. I was received by the Central Appeal Office and police at Tiananmen Square when I went to appeal in Beijing in March 2000, but what awaited me back home was prison, forced labor, dismissal from the Party, and loss of my job.
Several individual law-breaking police officers brutally beat my wife, Zhao Xiangzhong, and me while I was being processed for the forced labor at the Huangzhong County Public Security Bureau on June 18, 2001. On the afternoon of that day, the police from the Tianjiazhai Police Station under the Huangzhong County Public Security Bureau tore away our shirts, and then they gabbed us by the hair and hit our heads against the wall next to the entrance of the police station. I lost consciousness instantly. On the evening of that day the police on duty again savagely beat me while I was detained as a felon at the Huangzhong County Public Security Bureau Detention Center. He did not stop after he punched my face and head with his fist. He ordered several inmates at the detention center to take turns to brutally beat me. I again passed out. When I woke up I was lying on the ground in front of the "Officer on Duty Room" of the detention center. I suffered from a severe headache and nausea, as well as sharp pains in my lower back and legs. I could only limp along during mealtime.
During my detention, I had asked detention deputies many times for a physical examination of my injuries, yet no one gave me any reply regarding any medical treatment. By the time I was transferred to the Duoba Labor Camp, there were still numerous scars and bruises left from their torture on my lower back and legs. The torture caused permanent damage, including chronic headaches, nausea, sharp and unbearable pains in the lower back, and numbness of the limbs. I reached a point where I could no longer take care of myself. Lumps developed in my wife's left breast due to the beating.
I had written numerous times to the Xining City People's Procurator Office, the Huangzhong County Procurator Office and other higher government agencies to report those individual law-breaking police officers and their illegal activities. Yet, to this day, I have received no reply. Furthermore, facing the slander and defamation waged with the entire nation's propaganda machine and the persecution instigated by certain individuals in our government, we, as Falun Gong practitioners, have no other means to file our complaints and to voice our grievances. I would like to point out that a society with a proper legal system will provide even criminal suspects the right to defend themselves, either by themselves, or with lawyers in a fair and just environment. Yet in our so-called People's Republic that claims "The people are the master of their own destiny," why are millions of citizens who strive to become good persons forced to be in a position where wrong and injustice cannot be exposed, and their suffering and pain cannot not be told?
Under such extraordinary circumstances, we Falun Gong practitioners sought peaceful means to clarify the facts about Falun Gong according to the constitutional right guaranteed under the Constitution of the People's Republic of China. Even the TV interception method taken by us was also based on the constitution and the spirit of the U.N. Covenant on Economic, Social and Cultural Rights, which our country signed and ratified. It was a righteous act aimed to appeal to the public and to debate the issue in an open, fair and public environment. The contents of the TV interception were all facts, and what it discussed was truth. On the contrary, the "law" referred to by the Xining Intermediate People's Court was established in blatant violation of the legal process. It is itself against the Constitution of the People's Republic of China. How could it be used as the basis for the judgment?
The above facts are not irrelevant to this case, which clearly show that those who undermine the country's law enforcement, endanger the safety of society, and violate the lawful right of its citizens are not Falun Gong practitioners, but are those government officials who ignore the Constitution in order to formulate laws to persecute Falun Gong practitioners; those law-breaking police who openly ignore the legal process, knowingly violating the law as law enforcement officers, and brutally torture Falun Gong practitioners; those law-breaking government officials who disregard the cardinal principles of righteousness of our nation and ethics of society, who care only about their own self-interest and position; and those bureaucrats and corrupted officials who cover for those law-breaking police officers. They are the real offenders who undermine social stability, trample on the Constitution, and deceive people with lies.
During the initial trial of this case, the Xining Intermediate People's Court seriously violated the legal process of the trial, blocked and prohibited the plaintiff's legal self-defense and his statement to the court many times, stripped the right of the plaintiff to defend himself according to the law, and violated his legal rights.
Out of all the evidence presented during the initial trial, they only considered how the plaintiff intercepted the TV broadcasting and broadcasted information about Falun Gong, but never listed the specific broadcasting content of the Falun Gong TV interception. This shows that the above evidence is incomplete and cannot be used to establish the crime of the plaintiff. Therefore, the plaintiff asks the Superior People's Court to consider the facts as evidence, using the law as the measuring yardstick, declare that the plaintiff is free of the false charge and return innocence back to Falun Gong practitioners.
