Requests:
1. Stop the defendants from committing illegal acts of persecution against Falun Dafa practitioners, terminate all brainwashing classes, and unconditionally release all detained practitioners.
2. Compensate the plaintiffs for all financial losses caused by the persecution, restore employment and living arrangements for all practitioners who have been forced to flee their homes in order to avoid persecution.
3. Apologize publicly to the plaintiffs.
4. Bring all the perpetrators to justice.
Facts, explanations, and legal basis:
According to Article 33 of the Constitution of the People's Republic of China, "The State should respect and protect human rights. Basic human rights include the right to live, the right to be educated, the right to possessions, the right to personal information, the right to know, the right to human dignity, the right to housing, the right to personal freedom, the right to express oneself, the right to religious freedom, the right to vote or to be voted into public office, the right to assemble, the right to parade/protest, etc." Through their own experiences and practice, practitioners have verified that Falun Gong has greatly benefited their physical and mental health. As a result, they are willing to practice Falun Gong of their own free wills. Practicing Falun Gong is their basic human right, which should be respected. No organization or any person has the right to interfere or to take away their right to practice.
Since July 20, 1999, however, authorities of the Central Transportation Company, headed by Zhou Bingkai, have abused their power and ignored the laws while conducting an extended persecution of practitioners. The perpetrators have used illegal methods such as detention, beatings, extortion, harassment, ransacking homes, withholding pay, dismissal from professional positions, limiting personal freedom, forced labor camp sentences, brainwashing, and force-feeding. Their crimes have seriously violated these citizens' basic human rights, restricted their personal freedom, taken away their property and money, and sorely injured them and their families. Their deeds violated Articles 13, 33, 35, 37, and 39 of the Constitution and Articles 234 and 247 of the Criminal Law Code.
1. Facts
After July 20, 1999, perpetrators in the Central Transportation Company tried to force practitioners to write the "Three Statements." They threatened to fire the practitioners from their jobs if they didn't comply. They detained the practitioners that were unwilling to write the statements and extorted money from them. Furthermore, the persecutors monitored and harassed these practitioners for long periods of time. For instance, the practitioners were forced to report to the persecutors whenever they wanted to leave their homes. The perpetrators also followed the practitioners whenever they went out and tapped their phones. Sometimes the perpetrators called practitioners late at night and threatened them. Practitioners were followed even when they wanted to visit their parents. During holidays and the so-called "sensitive days," those responsible maintained tight control over the practitioners. Their actions have terrorized these practitioners for a long time, seriously harming their mental health and profoundly interfering with their normal lives.
In early 2000, the Central Transportation Company established a brainwashing center at the training school. Those responsible hired guards for the brainwashing center. Nearly all the practitioners in the company have been forced to attend brainwashing sessions at some point. They were not released from the center unless they were "Reformed" and wrote the "Three Statements." During their detention in the brainwashing center, the practitioners were not paid any salary and their family members were forced to deliver food to them every day. Xu Tingde and Wang Zhiqiang, the brainwashing center directors, are under the control of both the Central Transportation Company and the local 610 Office. They used various methods to torture the practitioners. Every day they forced the practitioners to watch video programs that slandered Teacher Li and Falun Dafa. They also tried to force the practitioners to give up their beliefs, threatening to fire them from their positions and send them to forced labor camps if they refused. Three practitioners refused to write the "Three Statements," so Zhou Bingkai issued orders for them to be sent to the Wangcun Brainwashing Center of the 610 Office. In addition, each of the three practitioners was forced to pay 5,000 yuan in extortion money, which the authorities referred to as a "fine."
In 2001, the Central Transportation Company's brainwashing center was listed as one of the major brainwashing centers by the Shengli Oil Field Management Bureau. The oil field's 610 Office directly controlled the brainwashing center. According to incomplete statistics, the oil field's 610 Office sent more than 100 practitioners who work for the oil field to the Central Transportation Company's brainwashing center. Currently, the perpetrators extort 100 yuan from each practitioner detained in the brainwashing center every day, which they call "living expenses." Actually, 50 yuan is for the practitioner's living expenses, while the other 50 yuan is used to pay the collaborators who help to brainwash the practitioners. The money is taken out of the salaries of the detained practitioners. Many practitioners have had as much as 5,000 yuan extorted from them, others more than 10,000 yuan. In the brainwashing center, many practitioners were beaten, some were detained for six months, and some were even detained for over a year. The practitioners lose all their personal freedoms in detention, as they are not allowed to make phone calls or meet with visitors or go outside. Nearly every detained practitioner has been beaten or cursed at. The perpetrators make up many "rules" and verbally insulted the practitioners on a regular basis. The persecutors often put practitioners in confinement cells as punishment. Wang Zhiqiang verbally abused female practitioners many times.
Five practitioners from the Central Transportation Company, including Tang Zhanchen and Wang Fengqin, went to the provincial government to appeal for Falun Gong and clarify the truth to the related government agencies, yet the Central Transportation Company and the Binhai Police Department detained the five practitioners and illegally ransacked their homes. They also extorted 2,000 yuan from each of the five practitioners and later on sent them to the Central Transportation Company's brainwashing center. During their detention in the brainwashing center, these practitioners were paid 300 yuan a month for living expenses instead of their regular salaries. They were also "fined" 50 yuan per day.
In 2004, the Central Transportation Company teamed up with the Jidi Police Department and spent about a month arresting practitioners and ransacking their homes. The arrested practitioners included Sui Wenxuan, Tang Zhanchen, Shen Xiaoyuan, Yang Chenghan, and Yang Chenghan's wife, and son Yang Jian. The six practitioners are still being detained. Yang Jian and Shen Xiaoyuan are illegally detained in the Shengli Oil Field Detention Center.
Specific Cases
1. Mr. Jiang Haisong, a 30-year-old practitioner, is an employee of Shengli Oil Field's Central Transportation Company. Mr. Jiang was mentally and physically healthy. In February 2002, the Central Transportation Company arrested Jiang Haisong and detained him for a long time without reason. Guards from the company's Security Section also ransacked his home and took away his Falun Dafa books. Jiang Haisong went on a hunger strike to protest the persecution and requested the return of his books. On the eighth day of his hunger strike, the persecutors tricked him into going to the Shengli Oil Field Number 8 Factory's Mental Hospital by claiming they were taking him there for a medical exam. In the mental hospital, the perpetrators tied Mr. Jiang's hands and feet to a bed and forcefully administered drugs intended to destroy the central nervous system. Mr. Jiang resisted and refused to take the drugs. The perpetrators then shocked him with an electric current. Five nurses held Mr. Jiang's limbs while Wang, the head nurse, turned the electric current to the maximum and touched the electrodes to Jiang's temples. Wang shocked Jiang Haisong like that continuously while saying, "Let's see if you dare to refuse the drugs again. Here's a lesson!" The strong current shocked Mr. Jiang and caused unbearable pain. The pain was so severe that his body twitched violently, and he cried out wildly in misery. After 67 days of torture, Jiang Haisong was extremely pale, and he became mentally ill. The perpetrators then organized police guards to visit Mr. Jiang in the mental hospital, telling the guards, "Look, here is a person deceived by Falun Gong. He became insane as a result of practicing Falun Gong." The persecutors often used this method to deceive people. Jiang Haisong's parents repeatedly went to the Central Transportation Company to request his release, but their requests were ignored. Unable to bear this huge tragedy, Jiang's mother suffered a mental collapse, and Jiang's father had a heart attack.
In 2003, because Jiang Haisong distributed truth-clarifying materials, the Central Transportation Company and Jidi Police Department sent him to the Wangcun Forced Labor Camp for a three-year term. During his detention in the labor camp, Mr. Jiang was again sent to Shengli Oil Field No.8 Factory's Mental Hospital for three months and was tortured there. Later on, Mr. Jiang managed to escape. Then he had no choice but to leave home and move from place to place to avoid capture. His current whereabouts are unknown.
2. Mr. Niu Guangfa is in his forties. He is an employee of the Truck Team under the Gudao Division of the Central Transportation Company. Because Mr. Niu went to Beijing to appeal many times, the authorities punished him, beat him, extorted money from him, and detained him on many occasions. In July 2000, the Binhai Police Sub-Bureau sent Mr. Niu to the oil field's detention center, where he was detained for a month. Director Zhang Dapeng slapped Mr. Niu's face and put shackles on him that weighed 22 pounds. The shackles created a deep dent on Niu Guangfa's ankles and later left a very thick scab. Shortly after Mr. Niu was released, Guo Zhenhua, Party Secretary of the Gudao Division of the Central Transportation Company, and others planned to send him to the Wangcun Forced Labor Camp. After Niu Guangfa learned the news, he was forced to leave home and go into hiding. His work unit sent people to Mr. Niu's parent's home and threatened his parents, who are in their eighties. They told Niu Guangfa 's parents that Mr. Niu was a "counter-revolutionary" and an "escaped criminal" and that Niu's parents must turn him in once they learned his whereabouts, or they would be punished for "covering up the crime." Scared and worried, Mr. Niu's parents both became critically ill. In addition, the Central Transportation Company fired Niu Guangfa for "not coming to work." Mr. Niu has been forced to stay away from his home for four years. He is jobless and has no way to seek redress for this unfairness.
3. Ms. Wang Fengqin is a 63-year-old retired employee of the Central Transportation Company. Since she started to practice Falun Gong, she had been in good health and lived a harmonious life with her family. After the persecution started in July 1999, Ms. Wang wrote letters in which she clarified the truth to the relevant agencies at all national and provincial levels and to the Shengli Oil Field. Because of the letters she wrote, the authorities detained her for a long time. Around the so-called "sensitive days," Central Transportation Company personnel monitored her near her home and followed her when she went outside.
In November 2000, Wang Fengqin was again forced into the Central Transportation Company brainwashing center and detained there until May 2001. Because she still refused to give up practicing Falun Gong, they transferred her to the Wangcun Brainwashing Center inside the Wangcun Forced Labor Camp, which is under the direct control of the Shandong Provincial 610 Office. In the Wangcun Brainwashing Center, the persecutors did not allow Ms. Wang to sleep for three consecutive days, and they ordered inmates to monitor her in two-hour shifts so that she was always under the tight control of two inmates during the 72-hour period. Under the brutal torture and extreme pressure, Ms. Wang was forced to write the "Guarantee Statement" against her will and was then released. Once she was released, she immediately published a solemn statement voiding everything that she was forced to write and stating that she would continue practicing Falun Gong with determination. In order to avoid further persecution, Wang Fengqin was forced to leave her home and move from place to place. After more than three years, she still cannot go home.
4. Mr. Tang Zhanchen is in his sixties. He is a retired employee of the Central Transportation Company. On the morning of November 11, 2004, over 10 perpetrators from the Central Transportation Company, the Shengli Oil Field 610 Office, and the Jidi Police Department broke into Mr. Tang's home in broad daylight. Without any legal procedures and with no stated reason, they violently pushed Tang Zhanchen to the floor and savagely abducted him. Mr. Tang has been secretly detained in the brainwashing center of the oil field's Supply Division inside the Central Storage Hotel. Before he was abducted, Mr. Tang had been monitored for a long time. They monitored his home from a nearby location, following him whenever he went out, and tapped his home phone. His work unit had also illegally detained Tang Zhanchen for an extended period of time after July 20, 1999.
5. Mr. Shen Xiaoyuan is in his sixties. He is also a retired employee of the Central Transportation Company. Perpetrators from the Central Transportation Company, the Shengli Oil Field 610 Office, and the Jidi Police Department worked together to deceive Mr. Shen. They called him at his daughter's place in Hekou City and tricked him into coming back. Then they ordered Zhang Huibo, the director of the Truck Team of the Oil Transportation Company, which is a division of the Central Transportation Company, to pound on Shen Xiaoyuan 's door with three police guards to try to illegally search his home and abduct him. Mr. Shen raised his voice and denounced them, saying, "You used mean and shameless methods to deceive me into coming back. Now you are trying to ransack my home and abduct me. You are following Jiang's regime to commit crimes, and you will surely be punished for these crimes. If you dare to tell me your name, practitioners will expose your crimes all over the world." The leading police guard had a scar above his eyes. He showed the search warrant but didn't dare give his name. They also told Mr. Shen not to speak so loudly. Finally, the four guards left in a hurry. That same night they returned in several cars and tried to sneak into Mr. Shen's home through the window. They shouted outside the building and disturbed the neighbors. They left in vain around 10 p.m.. The next day, Zhou Bingkai was dismissed from his position, but the perpetrators didn't give up. They secretly monitored and followed Shen Xiaoyuan for more than 10 days and then secretly abducted him. Shen Xiaoyuan is being detained at the Shengli Oil Field Detention Center.
6. Mr. Yang Chenghan and his wife are both retired employees of the Central Transportation Company. Their son Yang Jian is an employee of the Thick Oil Refinery Plant. In November 2004, the persecutors arrested the three practitioners and the two families, taking away property such as computers and printers. Yang Jian is currently detained at the Shengli Oil Field Detention Center. Yang Chenghan and his wife are detained in the brainwashing center of the Central Transportation Company.
7. Mr. Shen Yongdong is a retired employee of the Gudong Oil Extraction Factory, where he used to be the director. Although he is already 78 years old, the perpetrators still abducted Ms. Shen and took him to the brainwashing center of the Central Transportation Company in May 2002. They illegally detained him in the brainwashing center for five and a half months and appropriated 5,000 yuan from his salary. The police also extorted almost 20,000 yuan from him.
8. Ms. Xia Deyun is a 38-year-old college graduate. She used to work as an engineer at the oil field's Geological Research Institute. On the afternoon of January 28, 2004, the authorities abducted her and brought her to the brainwashing center of the Central Transportation Company, where Ms. Xia went on a hunger strike to protest the persecution. On the sixth day of her hunger strike, Wang Zhiqiang ordered several people to force-feed Ms. Xia. Wang also participated in the force-feeding himself. On February 2, 2004, the ninth day of Ms. Xia's hunger strike, Wang Zhiqiang, the Shengli Oil Field 610 Office, and the Geological Research Institute ordered 10 people to bring Xia Deyun, who by that time was extremely weak, to the Wangcun Brainwashing Center inside the Wangcun Forced Labor camp, to use more brutal methods to torture her. Because Xia Deyun failed the medical examination, the forced labor camp refused to admit her. The perpetrators then secretly brought Ms. Xia to the hospital of the forced labor camp, where they tortured her. Xia Deyun's family members investigated and discovered the situation. Because of their adamant demands, the family members were finally allowed to take Ms. Xia home from the forced labor camp.
9. Mr. Li Xiaodong is a 30-year-old employee of the Xianhe Oil Extraction Factory. Because he firmly practiced Falun Dafa, the persecutors forced him into the brainwashing center of the Central Transportation Company in the summer of 2000. From there, Mr. Li was transferred to the Shengli Oil Field No. 8 Factory's Mental Hospital for a month, where those in charge injected him with drugs that destroy the central nervous system. In 2001, his employers fired Li Xiaodong with a severance settlement. In 2002, Mr. Li was sent to the brainwashing center of the Central Transportation Company again and detained there for six months.
10. Mr. Wang Shaohua is a 40-year-old college graduate. Mr. Wang is an employee of the Well Cementation Company of the Huanghe Well Drilling Corporation in the Shengli Oil Field. Since July 20, 1999, the company has repeatedly attempted to brainwash him, but he firmly maintained his belief in Falun Dafa. In 2000, the directors of the company sent Mr. Wang to work in the Xinjiang Autonomous Region, a remote area in northwest China. After arriving in Xinjiang, Wang Shaohua was illegally detained by the local police for handing out truth-clarifying materials. He was sent back to Shandong Province in January 2001 and isolated within the company's grounds to be brainwashed. After failing to brainwash Wang Shaohua, under the direction of the oil field's 610 Office, the company sent him to the notorious Wangcun Forced Labor Camp to continue the persecution against him. But Wang Shaohua soon escaped from the labor camp. He had to live a life of destitution and homelessness in order to avoid being detained again. Under the enormous pressure, Mr. Wang's wife divorced him. Their child is now in the care of grandparents.
On October 25, 2003, the company sent someone to illegally arrest Wang Shaohua from his hometown in Jiangsu Province. After they brought him back to the company, he was illegally detained in the brainwashing class of the Shengli Oil Extraction Factory of the Shengli Oil Field. Four months later, they transferred him to the Wangcun Brainwashing Center in the Wangcun Forced Labor Camp, where he was subjected to inhuman torture for more than two months. During a medical exam, doctors in the forced labor camp found that Wang Shaohua had developed several diseases, so they sent him back to the brainwashing center of the Central Transportation Company in April 2004. Wang Shaohua was detained in the brainwashing center for another seven months and tortured to the point that he became critically ill and suffered a mental collapse. The perpetrators then had no choice but to release him.
11. Mr. Guo Shusen is a 35 -year-old employee of the Shengda Company. After he was abducted and put into the brainwashing center, Mr. Guo went on a hunger strike for more than 20 days. Even though his life was endangered, the perpetrators would still not release him. Instead, they sent Mr. Guo to the central hospital, where they continued to persecute him. Wang Zhiqiang went to the hospital, where he threatened and harassed Mr. Guo. Because of the protests and resistance of his family members, Guo Shusen was released.
12. Mr. Liu Cheng is an employee of the Dongxin Oil Extraction Factory. Mr. Liu is 27 years old. He was detained in Tuanhe Forced Labor Camp in Beijing for two years, yet he never gave in to the evil even under the brutal torture. In 2003, Liu Cheng was released and went back to the oil field. The perpetrators then forced him into the brainwashing center of the Central Transportation Company and persecuted him there. They beat him many times for refusing to write the "Three Statements." After Mr. Liu was detained in the brainwashing center for three months, he was transferred to the Wangcun Brainwashing Center, where he was barbarically tortured. Liu Cheng's life was endangered as a result, so the persecutors had no choice but to release him.
13. Mr. Chen Weihua is a 35-year-old college graduate. He was an engineer of the Oil Extraction Research Institute. Mr. Chen was illegally jailed for a year and then forced into the brainwashing center of the Central Transportation Company. One week after Mr. Chen went on a hunger strike, the persecutors transferred him to the Wangcun Brainwashing Center because he still refused to "reform." He was later released.
14. Ms. Zhou Yun is a 43-year-old employee of the Hygiene Clinic of the General Transportation Co-op. Ms. Zhou was forced into the brainwashing center of the Central Transportation Company in March 2003, where she was detained for 88 days and had 5,000 yuan extorted from her.
15. Mr. Li Jiwei and his wife Wei Shuying are both employees of the Xianhe Oil Extraction Factory. They were beaten, fined, and their home was ransacked. Mr. Li is currently detained at the Wangcun Forced Labor Camp.
16. Mr. Cao Xinghong and his wife Wei Xiurong (one of them works in the oil field's party school, the other worked for the former computer center of the Shengzhong Community Center) were arrested in October 2003. They were then sent to the brainwashing center of the Central Transportation Company and detained there for three months. They were also fined, and their child was left at home unattended.
Other practitioners who have been persecuted in the brainwashing center of the Central Transportation Company include:
Zhang Yan (Pump Company), Deng Xiuting (Shengzhong Community Center Computer Center), Zhang Zhonghua (Administrative Office Hygiene Clinic), Zhang Xiaoling (Oil Extraction Research Institute), Zhang Baoling (Central Hospital), Liu Guirong (family member of an employee of Power Supply Division), Lin Siai (family member of an employee of Gudong Oil Extraction Factory), Wang Baoyan (an engineer of the Geological Research Institute), Hu Guihua (Thick Oil Extraction Factory), Wang Qingmei (family member of an employee of the No. 3 Construction Company), He Baoqing (Auto Repair Plant), Yin Hongying (Shallow Sea Company), Sui Zhaoqing (Central Transportation Company Supply Station), Shi Rui (Oil Extraction Research Institute), Zhang Yinghua (Xianhe Oil Extraction Factory), Luan Xiuhua and Zhuang Shan (Chunliang Oil Extraction Factory).
Practitioners follow the principles of "Truthfulness, Compassion, Forbearance" and try to become better people. They only want to persevere in their belief, have their basic human rights restored, and stop the persecution. None of this is wrong. The so-called "Brainwashing Center" illegally detained innocent practitioners for extended periods of time. The persecutors treated the detained practitioners as criminal inmates and insulted and attacked them. Their deeds violated the laws. Our government has emphasized over and again that everyone should respect the Constitution and that the country should be ruled by law.
According to the facts and the relevant laws, we have submitted our legal request above. We hope the relevant agencies can resolve the issue according to the law and their conscience, and restore justice, leaving a good future for society and for themselves.
