(Clearwisdom.net) Background: After a four-year investigation, Judge Octavio Araoz de Lamadrid of the Argentina Federal Court No. 9 made a historic decision on December 17, 2009. Judge Lamadrid issued arrest warrants for the former leader of the Chinese Communist Party (CCP) Jiang Zemin, and Luo Gan, former head of the 610 Office, for their roles in the persecution of Falun Gong. The two high-ranking CCP officials were charged with crimes against humanity. Judge Lamadrid ordered the Interpol Department of the Federal Police of Argentina to carry out the arrests. In a 142-page legal document, the Judge elaborately assessed the CCP's persecution of Falun Gong practitioners in China, and the role that Jiang and Luo played.
The Real Scope of This Ruling
The ruling by Judge Octavio Araoz de Lamadrid, who ordered the arrests of former Chinese Communist Party leader Jiang Zemin and the former director of the 610 Office, Luo Gan, is sovereign, and emitted by one of the three powers which legitimately constitute the nation of Argentina, and is in concordance with the human rights politics initiated in 1983 when democracy was restored by the current government. We trust that the judge's ruling will not be subject to any external interference, and the sovereign integrity of the Republic of Argentina will be respected. This was the Spanish government's stance when confronted with the same pressures due to the recent opening of a criminal inquiry against the heads of the Chinese Communist Party for genocide of Falun Gong practitioners, thus affirming and respecting the separation of powers.
The Alleged "Political Motive" of the Ruling
The ruling is entrusted and limited to revealing the truth about the genocide being conducted against millions of innocent people in China who adhere to the principles of Truthfulness-Compassion-Forbearance rooted in the teachings of Falun Dafa.
This one hundred forty page ruling is the result of four years of painstaking investigations and includes the translation of extensive reports from the United Nations and other organizations, the tireless work to obtain oral testimony from around twenty witnesses, including seventeen direct victims from faraway places such as the USA, Oceania, Europe, and the acquiring of other evidence.
The case has to do with torture, mass murder and even organ harvesting and subsequent murders targeting a group of 100 million good and innocent people. These crimes, which are being carried out currently in China, are crimes against humanity. This means they are crimes against the entire human race, which therefore can and should be tried without consideration of territoriality or nationality of the victims or the perpetrators. This is the principle which has been successfully applied since the judge accepted the claim four years ago, and during the entire process to complete the ruling, sufficient evidence was gathered.
Therefore, to lightly throw about phrases such as "political motives" in relation to this ruling is not only closing one's eyes to the whole process of a legal case, but is actually favoring those committing these crimes. It is positioning oneself on the side of the dictators who commit genocide over a judicial decision which definitely will be remembered by future generations as a historic step toward the wellbeing, justice and prosperity of humanity.
We call on all political and non-political sectors, whether pro-government or opponents with reference to national politics, regardless of ideology, to dismiss whatever currents or conflicts which are not directly related to the case itself, and to support this decision, which concurs with national standards on human rights, universal moral values and the general principles of democracy.
On the Misleading Reference to a Motive to "Damage" Bilateral Relations
Obviously the judicial rulings, which try to investigate and judge those responsible for crimes against humanity, are not "damaging the relations" between China and other countries. It is rather the Chinese Communist Party's attitude towards human rights and its failure to observe them, which definitely should not be accommodated in an appropriate relationship with democratic countries that advocate for the defense of human rights.
It is important to be clear that the "Chinese Communist Party" (CCP) is not "China." The CCP maintains a dictatorship over China by an oppressive police state, devoid of freedom of belief, association, thought, and ultimately freedom, as understood in the free democracies -- a group which Argentina joined after her reintegration to democracy in 1983 -- and which was strengthened so that judges can investigate and condemn the serious crimes committed in the past.
It is obvious that the intention of the complaint and of the practitioners of Falun Gong throughout the world is to stop a genocide that is taking place against innocent people who practice the principles of Truthfulness-Compassion-Forbearance.
The meaning behind "good bilateral relations" referred to by the spokesperson from the dictatorship dominating China is that the representatives and legal systems of other countries turn a blind eye to crimes against humanity being committed by the CCP against innocent people, thereby destroying the consciousness of the people of the world by manipulating business opportunities, and bringing only abuses and disgrace to both peoples.
Condemnation of and helping to stop the slaughter of innocent Chinese people is what the spokesperson of the fugitives Jiang Zemin and Luo Gan labeled "damaging bilateral relations."
The leaders of a country entrusted to defend human rights such as in Argentina know that maintaining solidarity against the serious human rights violations is the best way to ensure good relations with China. We are confident that Argentina will continue on this path that will bring blessings to the people of Argentina.
On the Persecution of Falun Gong by the CCP According to the "Laws of China"
This is, first, recognition of the persecution. There are already ample reports from the United Nations and major human rights organizations concerning how the Chinese Communist Party uses the legal and judicial system to carry out human rights violations, and all of this has already been evaluated by the judge. The mere mention of considering this atrocious persecution of Falun Gong in China as "'legal" reminds us of the time when countries accepted the Nuremberg racial laws as legal and then remained quiet for seven years during the persecution carried out by the Nazi government against the Jews. The West only reacted to this dilemma when it was too late.
