(Minghui.org) Falun Gong practitioner Mr. Jiang Zonglin was the former director of the Mingyuan Architecture Institute. He was sentenced to five years in prison merely for practicing Falun Gong. After his term ended on October 15, 2012, he was not released, but was directly transferred to the Xinjin Brainwashing Center by the Jinniu District 610 Office and Fuqin Residential Committee personnel.
Mr. Jiang's wife, Ms. Xie Chengxin, daughter, brothers, friends, and co-workers went to the Xinjin Brainwashing Center to ask for Mr. Jiang’s release. Brainwashing center director Yin Shunyao and 610 Office personnel deceived his wife and daughter into entering the building where Falun Gong practitioners are detained, and locked them inside.
Below is Ms. Xie's indictment. She has asked for the immediate release of her husband, Mr. Jiang, and their daughter Jiang Zhujun, the return of their personal belongings, compensation for their losses, and prosecution of the responsible parties.
Charges:
Plaintiff: Xie Chengxin, female, 62 years old, 8 Yingtong Street, Chengdu City
Accused: Li Hongping (Fuqin Police Station Director) and Wang Feng (Jinniu District Police Department Head)
Requests:
1. Immediately release Jiang Zonglin and Jiang Zhujun, who have been illegally detained.
2. Hold liable and punish those police who illegally detained, robbed, and persecuted Falun Gong practitioners.
3. Hold liable and punish the Fuqin Police Station police who intentionally murdered Falun Gong practitioners.
4. Return personal belongings and apply the national fund for compensation of the loss by Ms. Jiang Zonglin's family.
Facts and Reasons:
On October 15, 2012, my husband Jiang Zonglin's prison term ended, but instead of releasing him, Fuqin Police Station officers transferred him to the Xinjin Brainwashing Center—officially called the “Chengdu Legal Education Center”--located in Caiwan Village, Huaqiao Town, Xinjin County. To this day there have not been any legal documents or notification to the family of this detention. This did not go through the court or Procuratorate. It was basically kidnapping and it has taken away Jiang Zonglin's personal freedom. It severely violates the law. It has been over four months since then and according to China's Criminal Law Article 138, it is illegal detention.
Even worse, on December 22, 2012, when several of us, including his family and friends, went to the brainwashing center to ask for his release, at first they would not let us see him. Then, Fuqin Police Station officers and the brainwashing center personnel called us and said they would release him, and asked me and my daughter to go into the building. They detained us once we got there. The police did not show any documents to Jiang's brother, who was also there. To this day there have been no documents about the detention whatsoever. They deprived our personal freedom without cause, and according to Article 138 of China's Criminal Law, this is illegal detention.
According to Article 37 of China's Constitution, “No citizen may be arrested except with the approval or by decision of a people’s procuratorate or by decision of a people’s court, and arrests must be made by a public security organ.” In Chinese law, including the Criminal Law, Administrative Punishment Law, Management Ordinance Punishment Orders, Legislation Law, and the Constitution, nowhere does it mention brainwashing centers. But they all clearly define illegal detention.
The Xinjin Brainwashing Center is basically a Nazi-style concentration camp that specializes in mental persecution. There have been countless crimes committed there:
1. Illegal detention. The personal freedom of around 1,000 Falun Gong practitioners has been forcibly taken away. For example, Fan Ying was detained there for almost five years.
2. Intentional murder. Seven Falun Gong practitioners are known to have been killed in the brainwashing center, including Wang Mingrong.
3. Assault. In order to force Falun Gong practitioners to give up their beliefs, the brainwashing center uses all kinds of brutal ways to physically torture Falun Gong practitioner. For example, Huang Min went on a hunger strike to protest the persecution, and was brutally forced-fed and one of her teeth was pried out.
4. Extortion. The brainwashing center extorted tens of millions of yuan from Falun Gong practitioners and their families. For instance, every practitioner's “brainwashing fee” per month is 16,000 yuan, and the “transformation” fee (for those who are forced to give up their belief) is 60,000 yuan.
5.Government officials deprive citizens of their freedom of belief. The director of Xinjin Brainwashing Center Yin Decai often refers to himself as a government official.
6. Genocide, torture, and crimes against humanity.
Fuqin police have also participated in the persecution and have committed many crimes. For instance, as early as in 2001, on June 28, Falun Gong practitioner, Fuqin Elementary School teacher Xu Zhilian was shot by Fuqin Police Station police, dragged into the police station, and then beaten to death. According to China's Criminal Laws Article 232, this is intentional murder.
As another example, in August 2002, they arrested Falun Gong practitioner Mr. Duan Shiqiong from his apartment in Fuqin's Xinan Road. Mr. Duan was a train attendant of Chongqing Train Bureau. They fabricated charges against Mr. Duan and sentenced him to seven years in prison. Mr. Duan went on a hunger strike to resist the persecution, and was brutally tortured to death. They also fabricated charges against many other Falun Gong practitioners.
Since 2003, in order to earn monetary rewards, Fuqin police repeatedly arrested Falun Gong practitioners, fabricated charges, and sent them to brainwashing centers. As they provided convenient conditions for the brainwashing centers to commit crimes, this violated the law according to Article 6 of Criminal Law.
Arresting Falun Gong practitioners and taking them to brainwashing centers without evidence violates the Police Law Article 22 and Criminal Law Article 238, which define Illegal Detention.
While clearly knowing that these are good people, the police are abusing their power and violating Criminal Law Article 399, which is acting outside the law.
On August 2, 2007, the police arrested all three of my family and took away several of our cars with no legal documents showing the whereabouts of our belongings. This violates Criminal Law Article 263, which is robbery.
All these also violate the Constitution, Law of Legislation, and many international laws. I hereby submit this accusation to Jinniu District Procuratorate, Police Department, Court to sue the illegal actions of the responsible police officers of the Fuqin Police Station. I also would like to call for help from the entire society.
