(Minghui.org) The day after Mr. Han Xu’s court hearing, his family filed a complaint against prosecutor Zhang Jing for using fabricated evidence to wrongfully charge their loved one.
Mr. Han, of Lanzhou City, Gansu Province, was arrested on May 29, 2019, and tried by the Chengguan District Court on October 15, 2020. He was targeted for his faith in Falun Gong, a mind-body practice that has been persecuted by the Chinese communist regime since 1999.
Mr. Han’s family received a text message on October 26 from the Lanzhou City Procuratorate that their complaint had been accepted and that they could expect to receive a result in three months. On October 27 and November 4, they received two more text messages informing them that their complaint had been uploaded to the Chinese Procuratorate’s website.
During Mr. Han’s hearing on October 15, a police officer testified that Mr. Han urged him to join the Falun Gong organization. Mr. Han’s lawyer argued that Mr. Han had clarified that Falun Gong doesn’t have a membership structure or organization and it didn’t make sense for him to ask the officer to join one.
The lawyer asked the police officer what exactly Mr. Han said to him. The police officer replied, “Before he started to talk, I knew he was about to promote Falun Gong.”
“If my client didn’t even talk, how did he promote Falun Gong?” asked the lawyer.
Prosecutor Zhang Jing accused Mr. Han of having cards printed with instructions on how to break through internet censorship in China. The lawyer responded that Mr. Han didn’t break any laws in having that information, as many government officials themselves are using software to overcome the internet censorship in China and visit websites abroad, including social media platforms like Twitter.
The prosecutor didn’t directly address the lawyer’s rebuttal but repeated that Falun Gong had been designated as a cult, without providing any legal basis for the claim.
The lawyer asked, “One of the witnesses said that my client Han Xu talked to him about Falun Gong at 2 p.m. and Han Xu was taken away by two officers at 2:05 p.m. According to the testimony by another witness, my client promoted Falun Gong to him at 2:40 pm. If my client was arrested at 2:05 p.m., how could he talk to people about Falun Gong again at 2:40 p.m.?”
The prosecutor remained silent.
Mr. Han also testified in his own defense. He said he used to be a very selfish person but completely changed himself after taking up Falun Gong. Because he refused to give up his faith, he was arrested and tortured to the verge of death. In a semi-conscious state, he was forced to admit guilt and later sentenced to ten years. His wife divorced him, and he lost his job. “Now the police is using my ten-year wrongful sentence to accuse me of being a repeat offender and trying to sentence me again. I think anyone with their conscience wouldn’t want to see me imprisoned again for being a good person,” he said.
Mr. Han, 54, used to work at the commercial department of Gansu Province Carpet Import and Export Corporation. He was also a translator for the provincial Foreign Trade and Economic Cooperation.
After the persecution of Falun Gong started, he was arrested multiple times, imprisoned, repeatedly beaten, handcuffed behind his back for long hours, shocked with electric batons, and held in solitary confinement for six years for not giving up his faith.
