(Minghui.org) China's procuratorates are charged with reviewing cases investigated by public security organs and determining whether to approve arrests and proceed with prosecution.
During the review process, the accused and his or her lawyer(s) are to be given access to police-provided evidence and other case materials in order to prepare their defense.
One procuratorate in Shijiazhuang City did anything but the above in handling the case against Mr. Li Yuxin, a car care company manager who is well respected by his colleagues for his integrity.
Following his arrest last November, Mr. Li's family and lawyer filed multiple requests to review case documents, but Chang'an District Procuratorate turned them away each time using various excuses.
Public prosecutor Zhao Zhuangtao forwarded Mr. Li’s case to Chang’an District Court on March 13, 2014, without verifying any evidence provided by the local police. The court proceeded to try Mr. Li on August 28.
When questioned by Mr. Li's family, a deputy director of the procuratorate stated outright, “We're just going through the motions. We'll do whatever the police want us to do!”
Mr. Li and his family filed a complaint to the supervising agency of Chang'an District Procuratorate, requesting an investigation of the procuratorate's dereliction of duty and removal of public prosecutor Zhao Zhuangtao from Mr. Li's case.
Possessing Falun Gong Materials Deemed a “Crime”
A group of agents from Chang’an District Police Department ransacked Mr. Li’s apartment in November 2013, and confiscated the Falun Gong books and other Falun Gong materials that his mother left for him before she passed away.
Using these books and other materials as “evidence,” the police had Mr. Li charged with “organizing and using a cult organization to undermine law enforcement.”
Case Review Was Just “Going Through the Motions”
After the police forwarded the seized materials to Chang'an District Procuratorate, Mr. Li’s family and lawyer submitted multiple requests to gain access to them.
However, public prosecutor Zhao Zhuangtao refused to provide the case materials, claiming that he could not find the person handling the evidence because he was on paternity leave.
Zhao soon forwarded Mr. Li's case to Chang'an District Court, without notifying Mr. Li’s family and his lawyer. The court accepted the case, despite the fact that the procuratorate never vetted the police-provided evidence as required by law, and that the defense lawyer was never given an opportunity to provide input on the case.
It became clear to Mr. Li's family that the CCP regime has a simple playbook for handling Falun Gong cases, where the police cooks up evidence, which is then accepted blindly by the court system to be used to sentence innocent people.
