(Minghui.org) The mother of a Falun Gong practitioner filed a criminal complaint against the main perpetrator of the persecution of Falun Gong, former Chinese dictator Jiang Zemin, on June 1, 2015. Her son, Mr. Jia Pengfei, was tried the very next day despite the fact that the local Procuratorate had dismissed his case about two months ago.
The criminal complaint was sent via express mail to the Supreme People's Procuratorate and the Supreme Court.
Mr. Jia Pengfei was arrested on March 25, 2015 for his belief in Falun Gong. He was not released even though his case was dismissed by the local Procuratorate.
The Xuanhua District Police Department submitted the case against Mr. Jia to the Procuratorate a second time on April 21, 2015.
His family hired an attorney, Mr. Zhang from Beijing, who visited Mr. Jia in the detention center on May 5, 2015. He also visited the Procuratorate to review the case and submitted a written request asking the Procuratorate not to prosecute his client.
Attorney Zhang stated that the “evidence” confiscated from his client's home by policemen from the Domestic Security division were all regular and legal personal items, and could not be used to convict Jia Pengfei. “It is not a crime to believe in and practice Falun Gong. Nor is it a crime to print and distribute Falun Gong material,” he stated in the request.
However, the Xuanhua District Procuratorate handed in the indictment against Mr. Jia Pengfei to the Xuanhua District Court on May 21, 2015.
The day after his mother filed a lawsuit, the Procuratorate and the Xuanhua District Court of Zhangjiakou City, Hebei Province held the trial at Xuanhua Detention Center. They only allowed two family members to attend. Mr. Jia's lawyer pointed out that the court had knowingly violated the law by holding the trial in a detention center, and all of the evidence presented were legal items and should not be used to convict his client. The judge had no response and announced a court adjournment.
Background
In 1999, Jiang Zemin, as head of the Chinese Communist Party, overrode other Politburo standing committee members and launched the violent suppression of Falun Gong.
The persecution has led to the deaths of many Falun Gong practitioners in the past 16 years. More have been tortured for their belief and even killed for their organs. Jiang Zemin is directly responsible for the inception and continuation of the brutal persecution.
Under his personal direction, the Chinese Communist Party established an extralegal security organ, the “610 Office,” on June 10, 1999. The organization overrides police forces and the judicial system in carrying out Jiang's directive regarding Falun Gong: to ruin their reputations, cut off their financial resources, and destroy them physically.
Chinese law allows for citizens to be plaintiffs in criminal cases, and many practitioners are now exercising that right to file criminal complaints against the former dictator.
