(Minghui.org) The Yaodu District Procuratorate in Linfen City prosecuted Falun Gong practitioner Mr. Song Wanlin by submitting his case to the Yaodu District Court on October 17, 2016. The case is awaiting a response from the judge.
Mr. Song was arrested on July 13, 2016 while handing out Falun Gong truth-clarification letters in Shanxi Teacher's University. The police ransacked his home the next day and confiscated his computer. They later searched his office at work and confiscated another computer.
Mr. Song was charged with “using a cult organization to undermine law enforcement” – a standard pretext used by the Chinese communist regime to prosecute Falun Gong practitioners.
The Linfen Domestic Security Division submitted Mr. Song's case to the procuratorate using the two computers and truth-clarification letters as evidence. The procuratorate approved Mr. Song's arrest on July 27.
Mr. Song's attorney prepared a legal opinion that justified canceling the arrest and submitted it to Wang Lisheng, chief of Linfen Domestic Security Division. It was requested that the chief put it on record and in Mr. Song's case file in accordance with Article 159 of Criminal Procedure Law. The chief, however, refused to accept the document on multiple occasions.
Kong Yuhong, head of the Yaodu District 610 Office, had asked Mr. Song's family to dismiss the attorney on September 5.
The judge failed to take action with Mr. Song's case for two weeks. He was reminded of it when Mr. Song's attorney visited him on November 2. The judge indicated that he had not dealt with Falun Gong cases prior to that.
The attorney had assembled some background materials and related law documents for the judge and briefed him. The attorney also explained to the judge the facts of Falun Gong, including that it is legal and that freedom of belief is guaranteed by the Chinese Constitution. The judge said he would study the case carefully.
Mr. Song is held at the Yaodu District Detention Center.
